1.Consular Legalisation/Apostillisation to China

Documents issued by non-member countries of the Convention Abolishing the Requirement of Legalisation for Foreign Public Documents ( hereafter referred to as "the Apostille Convention") and to be used in Chinese mainland, shall be legalised first by the competent authorities in that country, and then be legalised by the Chinese embassies or consulates there.
Documents issued by member countries of the Apostille Convention, can be used in Chinese mainland directly after being apostillised by the competent authorities.
2.Consular Legalisation/Apostillisation in China
(1)Introduction of Consular Legalisation/Apostillisation in China
In line with the Apostille Convention and Chinese regulation, documents issued by Chinese agencies can be used in the member countries of the Apostille Convention directly after being apostillised by the Ministry of Foreign Affairs of the People’s Republic of China (hereafter referred to as "MFA") or authorized Foreign Affairs Offices of local governments ( hereafter referred to as "FAOs") .
Documents issued by Chinese agencies to be used in non-member countries of the Apostille Convention, in general, shall be legalised first by MFA or authorized FAOs, and then be legalised by the embassies or consulates of those countries in China.
Generally, documents required for Consular Legalisation/Apostillisation are as follows: Certificate of birth, death and marriage, non-criminal record, kinship, academic qualification, professional qualification, declaration paper, entrustment paper, power of attorney, articles of association, certification of inspection and quarantine of animals or plants, certificate of origin, invoice, and other notarial certificates, etc.. These documents are issued by Chinese notary public offices, Chinese customs, and China Council for the Promotion of International Trade (CCPIT).
(2)Instruction of Applying for Consular Legalisation/Apostillisation in Chinafrom MFA
(1) When applying for Consular Legalisation/Apostillisation, legal and valid ID (Foreign citizen should submit their original passports or other international travel documents and a copy of the information page), the original notarial certificate (or CCPIT certificate etc.), and other materials required by MFA must be submitted.
(2) For documents needed to be legalised by MFA and the foreign embassies in Beijing, some FAOs or other authorized agencies can help applicants transfer the above said materials to MFA.
For documents needed to be legalised in the the foreign consulates in cities other than Beijing, provincial and some municipal FAOs in the consular district of the consulates are authorized to legalise the documents.

4.Processing Time and Fees for Consular Legalisation/Apostillisation

Note: Fees of Consular Legalisation by MFA (marked with *) are different for foreign applicants of different nationalities on the reciprocal basis.

(i) The express fee is collected only when the applicant requests express service. Beside, some foreign embassies also provide extra charged express services of their own, requests should be made upon submitting applications.
(ii) MFA provides mail back service. For mail-back applications, together with other required materials, applicants should fill out and submit EMS envelops at counters.
(iii) All the fees stated above need to be paid while submitting applications. Pick-up forms and invoices will be given to the applicants after payment. The forms are the proofs for picking up documents, and invoices are essential for refunding the overpayment and making up the balance due to the frequent changes of the fee charged by the Embassy.
